Catholic School Places Counselor on Leave Because of Same-Sex Marriage

In the same week that we learned that the Catholic Church in Pennsylvania covered up some 300 priests who had sexually abused children, the Catholic Church in Indianapolis, Indiana, has decided to suspend a dedicated high school guidance counselor because of her sexual orientation.  Shelly Fitzgerald, who has been with Roncalli High School on the south side of Indianapolis, for 15 years, was placed on paid administrative leave recently when it was discovered that she had married her partner in 2014.

In a Facebook message distributed to some parents, Fitzgerald said school officials said she could resign or dissolve her marriage or risk being fired or not getting her contract renewed.

Legal experts seem divided on whether or not she can be fired.  Indiana is an “at will” employment state.  There are no protections for employees based upon sexual orientation.  Indianapolis, however, did pass an ordinance protecting employees based upon sexual orientation.  However, there are exemptions within that protection for educational and charitable organizations related to Churches.  So, the question comes down to what her duties have been.   Fitzgerald has hired an attorney. 

There has been an out-pouring of support for Fitzgerald, including from faculty, staff and past and present students.  People have been returning their Roncalli spirit wear, and one past Salutatorian returned his medal, asking that his name be taken off of the roll of honorees.  It is uncertain how all of this will play out.  In my experience with the Catholic Church, they are not a “bend the rules” kind of organization (unless you’re talking about 300 priests...).  But, one thing is for certain, they are teaching these young people something right now.  Because these young people know Shelly Fitzgerald.  They know she cares about them and their futures.  And the Church should think carefully before tossing her out so cavalierly.  These kids are watching.  And, I can’t help but think that, in their hands, our future might not look so bad.
